Nationwide Hemp and CBD Legalization
The passage of the 2018 Farm Bill eliminates any and all confusion as to whether hemp-derived CBD oil products are legal.
For years, hemp CBD oil companies in the U.S. have legally operated under a 2004 Ninth Circuit Court of Appeals ruling that prohibited the DEA from interfering with the production of hemp-based foods.
While hemp was classified as a controlled substance and prohibited under federal law, this ruling allowed hemp-derived CBD oil products to be legally used, bought, and sold. This had caused some confusion as to whether hemp CBD was actually legal.
The hemp provision in the new Farm Bill completely removes hemp from the Controlled Substances Act and reclassifies it as an agricultural commodity. It leaves no doubt that hemp can be legally “cultivated for any use,” including to extract CBD.
While states can regulate hemp and hemp CBD as they choose moving forward, this new federal policy completely changes the playing field for hemp-derived CBD products.
Push CBD into the Mainstream
Hemp legalization will no doubt help propel CBD further into the mainstream. A growing number of consumers who had perhaps been on the fence about CBD will now be more open to adding CBD products into their routines.
Also, large retail outlets and other distributors will now be more comfortable bringing hemp CBD products into their stores. This will not only make CBD more available, but will also help build awareness around the all-natural compound and its benefits.
